PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 29 September 1999, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct-pattern of misconduct, with a general, under honorable conditions discharge. He was advised of his rights. The applicant waived legal counsel, was advised of the impact of the discharge action, waived a hearing by a board of officers, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general, under honorable conditions discharge. On 19 October 1999, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a characterization of service of general, under honorable conditions.

         b. On 8 November 1999, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, 9 months, and 24 days of active military service in the period of enlistment under review and had a total of 18 years, 3 months, and 11 days of active military service.

         c. The applicant’s record also shows that the applicant was placed on probation for a period of two years by the Commonwealth of Kentucky, Christian Court District after his second offense of driving under the influence of alcohol. He was required to attend Alcoholic’s Anonymous two times a week and to pay a fine of $651.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1-11) The issues are rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The evidence in the applicant’s record shows that he received a summarized Article 15 for failing to report to his place of duty; and, two Article 15s for failing to go at the time specified to his place of duty. The record also contains numerous counseling statements for failing to go to his appointed place of duty, and a probation order from the Commonwealth of Kentucky placing him on probation for a period of two years as a result of driving under the influence on two occasions. These incidents of misconduct clearly diminished the quality of the applicant’s service below that meriting a fully honorable discharge. While the record supports the applicant’s contention that alcohol probably impaired his ability to serve, the Board determined that his misconduct was not outweighed by service of sufficient merit to warrant an upgrade of his last period of service. The Board also noted that the applicant was appropriately recognized for his prior periods of service with honorable discharges. Finally, the Board congratulates the applicant on any post-service accomplishments, however, he did not furnish the Board with corroborating evidence to support his contention that he has been a good citizen since his discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
